1. INTRODUCTION

1.1 You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.

1.2 We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

2. ORDERING FROM US

2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.   By submitting the Order, you enter into a legally binding Contract with Plumb Arena. In accordance with the provisions of the Consumer Protection (Distance Selling) Regulations 2000, you have the right to withdraw from this transaction. Details of Your right to withdraw can be found in the Cancellation and Return Policy at clause 4.

2.2 Our acceptance of an order takes place when we dispatch the order. We will send you a dispatch confirmation by email. When we dispatch the order, the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.

2.3 We may refuse to accept an order: (a) where goods are not available; (b) where we cannot obtain authorisation for your payment; (c) if there has been a pricing or product description error; or (d) if you do not meet any eligibility criteria set out in our terms and conditions.

2.4 We deliver to UK mainland addresses only and our maximum delivery lead-time is 14 working days from order placement. Our standard delivery lead times are usually well within this time frame and you will be advised our intended delivery date soon after order placement. If we cannot deliver within 14 working days we will offer alternative products of similar price or a full refund. 

2.5 We reserve the right to deliver only to registered billing addresses and not to none connected delivery addresses. This does not affect your statutory rights and we will make a full refund if you do not wish to receive delivery of your items at your registered billing address. Our delivery agents are instructed to return the product to stores if they are unable to substantiate that the delivery recipient is resident at the said delivery address.

2.6 You can browse for products using the categories or search for products using the search bar. As you type into the search bar you will notice products and categories are recommended. These are quick links to the pages matching the search and you can either click on them using a mouse or navigate them using your cursor (arrow) keys.  On the product page you will find a description, specification and images of the product.  For your convenience we list "Associated Products" alongside our product lines. We cannot say what associated products will be needed as this is dependent upon individual needs.
   
2.7 After clicking the ‘Add to Basket’ button you will be taken to the View Basket page. From here you can proceed to pay for the products in the Basket or continue shopping.  On the ‘View Basket’ page, you find the available payment options. The typical payment options are: -

• Visa, MasterCard and Maestro using an easy-to-use and secure checkout system. For your added protection, all online payments are "3DSecured" using the Verified by Visa and MasterCard SecureCode card protection schemes.  You may be asked by your bank to register your card or enter a password during the checkout process. We fully recommend that you register your credit/debit card if you are prompted to do so.
• Alternatively payment can be made via Cheque or BACS. Please contact us for further information, however, no goods will be dispatched until payment has cleared.
• We do not currently accept American Express.

2.8 Security is a priority, which is why all communication within our payment gateway uses PCI compliant encryption levels.  This ensures the Website is configured according to best practice. For more information on the PCI Security Standards Council, please visit their website.

PRICING

3.1 Our prices include VAT at the prevailing rate unless otherwise stated, i.e. for trade sales to bona fide trade purchasers who are not VAT exempt.

3.2 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.

3.3 Our prices are reviewed periodically and we accept no responsibility for omissions or errors on the Website if you are notified prior to delivery.

4. CANCELLATION AND RETURNS POLICY

4.1 If you wish to cancel your order you can; (a) notify us by email at admin@plumbarena.co.uk before we have dispatched the goods to you; or (b) where goods have already been dispatched to you, we require that you notify us in writing within 14 days of receipt of goods. Upon receipt of your written request, we will supply you with a returns number and address. You can then return goods to us in accordance with clause 4.2 below.

4.2 You can return goods you have ordered from us for any reason at any time within 14 days of receipt, providing you have requested a returns number in writing. The costs of returning goods to us shall be borne by you. The cost of carriage will not be refunded. Plumb Arena reserves the right to enforce a 25% restocking charge for non-faulty returns (also see Delivery & Returns policy).

4.3 Upon receipt of the goods we will give you a refund of the amount paid, an exchange or credit as required.
 
4.4 The rights to return the goods to us as referred to in clauses 4.2 will not apply in the following circumstances: 1) in the event that the product has been used 2) in the event that the packaging has been opened or tampered with.

4.5 Faulty returned parts will be sent to the manufacturer and tested. If the manufacturer deems the part faulty, Plumb Arena will credit 100% of the original value of the part to the Customer. If the part is deemed not faulty the restocking charge will be 25%. Plumb Arena are not bound to accept non-stocked items back into stock where the item is not a part of the Plumb Arena core range and was ordered especially for the customer.

4.6 If you purchased the item less than 30 days ago, and it is damaged or faulty, you can return it under our 30 Day Money Back Guarantee.  We will offer either a repair, exchange or refund if the fault occurs within 30 days of purchase.

If you purchased the item more than 30 days ago our aim is to get the problem put right as quickly as possible.  In the first instance, please check if the manufacturer offers a helpline, repair or warranty service. Using this service may be the fastest way to get the problem put right.

The provisions of clause 4.4 does not affect your statutory rights.

5. LICENCE

5.1 You are permitted to print and download extracts from this Website for your own use on the following basis: (a) no documents or related graphics on this Website are modified in any way; (b) no graphics on this Website are used separately from accompanying text; and (c) any of our copyright and trade mark notices and this permission notice appear in all copies.

5.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of these terms and conditions, any use of extracts from this Website, other than in accordance with clause 5.1 above, for any purpose is prohibited. Any additional rights given by the manufacturer in respect of Goods purchased are not incorporated into this Contract.  

For details, please refer to the manufacturer's guarantee provided with the Goods.  You have statutory rights regarding the return of defective Goods and claims in respect of losses caused by any negligence on our part or our failure to carry out our obligations. The Conditions of this Contract do not affect the consumer’s statutory rights.

12.GOVERNING LAW AND JURISDICTION

12.1 These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.

12.2 We do not warrant that materials/items for sale on the Website are appropriate or available for use outside the United Kingdom. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.

13. MISCELLANEOUS

13.1 You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions.

14. SELECTION, INSTALLATION AND USE OF PRODUCTS  

14.1 It is the purchaser's responsibility to ensure that the products selected are suitable for the application in question.  It is strongly recommended that advice is sought from a suitably qualified and competent installer prior to making the decision to buy.  Any product supplied by Plumb Arena should be installed by a person who is trained, competent and experienced.  No requests for returns will be accepted where a product has been incorrectly installed by a person not qualified to do so.

14.2 Under the Gas Safety Regulations, it is law that all gas appliances and components are installed and maintained by suitably qualified and Gas Safe Registered operatives.  Similar stringent regulations apply to other forms of fuel burning appliances and also the installation of electrical equipment and components.

14.3 All gas appliances must be installed by a Gas Safe Registered competent person. It is the responsibility of the competent person to ensure that the gas appliance is safe for use, is free from operational defects, its safety devices operate correctly, its flue system is fully functional, any ventilation requirements are met, any manufacturers installation instructions are strictly adhered to and any gas operating pressures are within tolerance.

Should an appliance, any gas safety device, or gas carrying component sold by Plumb Arena be subsequently installed by someone not legally competent to do so, any warranty and return requests may not be accepted.
